On Tuesday afternoon, U.S. Supreme Court Justice Brett Kavanaugh denied the state's bid to keep the new map in place, leaving the state's Supreme Court decision in place ordering the use of a 2022 map instead.

The ruling from the Eighth Circuit Court of Appeals declined to block Judge Stephen R. Clark’s decision, which found that the map can be used in November. The ruling comes as Missouri Republicans are attempting to push the map through ahead of the Nov. 3 election despite a state Supreme Court decision blocking it.

Justice Brett Kavanaugh turned down a Republican-backed emergency appeal that sought to block a Missouri Supreme Court ruling last week restoring earlier district lines and ordering voters to weigh in on the redistricting plan in November for use in future elections.

Missouri’s Supreme Court blocked election officials from using a new congressional map, saying voters must first approve the district lines in a statewide referendum.

The court's ruling overturns unilateral action from Missouri Secretary of State Denny Hoskins declaring unconstitutional a ballot measure with enough signatures to go before voters.
